Brasil – Passado, presente e futuro da Constituição são tema de seminário

Um olhar para o passado, reflexões sobre o presente e a construção do futuro da Constituição Federal. Esta é a discussão proposta pelo seminário 25 Anos da Constituição Cidadã, que será realizado entre os dias 4 e 6 de setembro, no auditório externo do Superior Tribunal de Justiça (STJ), em Brasília. A participação é gratuita e as inscrições podem ser feitas até 23 de agosto, no site do Conselho da Justiça Federal (CJF). O evento é uma promoção do Centro de Estudos Judiciários (CEJ) do CJF.   O Painel I do seminário, “A História”, tratará do passado. O Painel II, “A Efetividade da Constituição”, discutirá o presente. A. nº 362481 (extrait) Elements Cles: Une sanction infligée en première instance par une juridiction disciplinaire ne peut être aggravée par le juge d'appel saisi du seul recours de la personne frappée par la sanction, juge le Conseil d'Etat. Il précise que cette règle qui résulte des principes généraux du droit disciplinaire s'applique y compris dans le cas où le juge d'appel, après avoir annulé la décision de première instance, se prononce par voie d'évocation. Relative à la compétence du juge d'appel, cette règle relève de l'ordre public et sa méconnaissance peut en conséquence être invoquée à tout moment de la procédure. España – La Abogacía Española rechaza la nueva Ley de Colegios Profesionales

  El Consejo General de la Abogacía Española ha manifestado su rotundo rechazo a la nueva Ley de Colegios Profesionales aprobada el pasado viernes en Consejo de Ministro, ya que considera que supone un claro intento de dividir la profesión entre abogado y asesor jurídico, figura que no necesita una colegiación obligatoria.   El organismo alerta, además, de que la nueva normativa será perjudicial para los ciudadanos ya que, sin la obligatoriedad de la colegiación, será más difícil asegurar una calidad de los servicios legales.   El Consejo de la Abogacía cree que la nueva ley provocará falta de seguridad jurídica y la pérdida de la confianza de los ciudadanos en los asesores jurídicos, que carecerán de la garantía que ofrece la exigencia formativa de los abogados y su incorporación a un…

USA – Ebix Said to Be Reviewed by U.S. for Money Laundering

  Federal investigators are reviewing Ebix Inc. (EBIX)’s cross-border financial transactions to see whether the Atlanta-based software company engaged in money laundering, according to three people with knowledge of the matter.   Ebix fell 88 cents to $10.91 or 7 percent in Nasdaq Stock Market trading yesterday. The shares fell almost 30 percent earlier in the day.   The focus on the company’s wire transfers around the globe follows the June disclosure by Ebix that the U.S. Attorney’s Office in Atlanta had begun an investigation into “allegations of intentional misconduct.”   The U.S. Attorney’s investigation upended a plan by Ebix Chief Executive Officer Robin Raina to take the company private. USA – DOJ sues Bank of America for fraud relating to financial crisis

[JURIST] The US Department of Justice (DOJ) [official website] on Tuesday filed suit [complaint, PDF] against Bank of America (BOA) [corporate website] in the US District Court for the Western District of North Carolina [official website], claiming the corporation misled investors about securitized loans worth more than $850 million. The complaint alleges that BOA deceived investors regarding the level of risk [Bloomberg report] associated with their products—specifically, the mortgage loans supporting the residential mortgage-backed securities. US Attorney Anne Tompkins elaborated on the DOJ's position,stating [press release]: Bank of America's reckless and fraudulent origination and securitization practices in the lead-up to the financial crisis caused significant losses to investors. UK – Right-to-die battle: court of appeal rejects paralysed man’s case

  The court of appeal has rejected a request by a paralysed man that doctors should be allowed to help him die.   Paul Lamb, 57, from Leeds, had taken on the "right to die" case originally brought by Tony Nicklinson, a sufferer of "locked-in syndrome" who died last year, and a week after losing his high court euthanasia battle.   Nicklinson's widow, Jane, supported the appeal against the previous judgment which, she said, had condemned her husband to a life he no longer wanted to lead. Both want to overturn the prohibition on doctors helping to end the lives of their patients.   By a two-to-one majority, however, the judges did uphold another appeal by a man, known only as Martin, who is suffering from "locked-in syndrome". USA – Ex-Baker & McKenzie Partner Gets to 2 Years for Fraud

  Former Baker & McKenzie LLP partner Martin Weisberg, who admitted to stealing from a client and taking part in a $55 million securities fraud, was sentenced to two years in prison, the U.S. said.   Weisberg, 62, pleaded guilty to conspiracy and money laundering in May 2012 after prosecutors alleged he skimmed $1.3 million in interest from an escrow account for a hedge fund client, SIAM Capital Management. USA – JPMorgan Sued With Goldman in Aluminum Antitrust Case

  JPMorgan Chase & Co. (JPM), the biggest U.S. bank, was sued with Goldman Sachs Group Inc. (GS) and Glencore Xstrata Plc (GLEN) over claims they restrained aluminum supplies and drove up prices.   The complaint was filed by a Jacksonville, Florida, direct purchaser, Master Screens Inc., and by individual plaintiff Daniel Price Bart of Tallahassee, who is described in the filing as a “purchaser of beverages sold in aluminum cans.”   The banks and Glencore are accused in the complaint filed yesterday in federal court in Tallahassee of racketeering and conspiring with the London Metal Exchange, hoarding aluminum in Detroit-area warehouses and violating federal antitrust laws. O novo marco normativo do Direito Concorrencial brasileiro, vigente há dois anos, promoveu o endurecimento do combate aos grandes cartéis feito pelo Conselho Administrativo de Defesa Econômica (Cade), mas deixou evidente a necessidade de difusão da cultura antitruste dentro do Ministério Público.
